Rental Terms & Conditions
1. VILLA RENTAL FEE
Rental fees are provided to the Client by invoice once the preliminary booking has been accepted. The client agrees to pay a deposit of 30% of the total rental charge on booking the Villa. Deposits are due within 7 days after the request for the Villa is made. Reservations are not confirmed until deposit is paid. Final payments are due 60 days prior to the event date. In the event that final payment is not made on or before 60 days prior to the first day of the proposed property rental date the Villa will be made available to other clients and the client shall be subject to the cancellation provisions below. Payments must be by wire transfer, certified cheque or credit card unless prior arrangements are made. A refundable damage deposit of USD1,500.00 returnable to clients after the event has been held and the property has been inspected for potential damage.
Guests show acceptance and agreement with the following terms and conditions by making a reservation payment to occupy the said villa/property.
- The Guest whose name appears in the contract, must scan an ID picture (National ID or Driver’s License) when sending their signed contract and show their ID upon check-in.
- Should you designate someone else to meet the check-in team at the check-in time agreed upon, this should be communicated prior to arrival via e-mail. He/She must present ID upon check-in.
- Names of all guest(s) must be provided.
2. OCCUPANCY
A. Maximum Occupancy: The maximum number of guests consists of the number of persons stated above (including children). If the number of guests staying at the villa exceeds the contracted number without prior approval, the rental agreement may be immediately terminated, without reimbursement of the rental fee or the Security Deposit.
B. Visitation: Unless approved by villa management, the number of visitors allowed on the premises cannot exceed 20 persons at any given time, inclusive of the guests renting the villa.
C. Over 14 persons at the villa is considered an event. An event charge and/or a visitor charge may apply. Additional staff may be supplied by villa management to ensure adequate levels of service for visitors. For contact tracing purposes, names of all visitors should be provided to villa management prior to visit.
3. CHECK-IN / CHECK-OUT INFORMATION
A. Check-In time is from 2:00 PM and Check-Out time is by 11:00 AM.
B. During on-peak periods, high season or for changeover days, the Check-In time is at 4:00 PM and Check-Out time is at 11:00 AM. Guests shall be notified whether the period for which they have booked is an on-peak or off-peak period.
C. There is an additional charge of one night’s rental will be charged for check in between 6:00AM-10:00AM. During the off-peak period, there is no additional charge for late check-out up to 2PM; A late check-out between 2PM and 6PM will attract a charge of 50% of the daily rental and will be subject to approval of villa management based on bookings. Guests will be charged at the daily rental rate for a check-out that occurs any time after 6PM. Please ensure that you get confirmation if early check-in or late check-out is possible before you arrive, as this situation may change at short notice. During non-peak periods, we will accommodate earlier check-ins as long as there aren’t any changeovers on the same day and once the villa is ready.
D. Guest changeover days shall be considered as days when a previous guest, not a party to the arriving group of guests departs the villa.
4. PAYMENT METHODS
A. Payments may be made via wire transfer or credit card. If payment is made via wire transfer, guests shall bear the cost of any service charges incurred by the Villa, and such charges shall be added to any outstanding balance.
5. CANCELLATION POLICY
Cancellations will incur a penalty based on the following:
A. No penalty will be applied for cancellations up to 90 days prior to arrival.
B. 30 % of the total rental amount will be forfeited if the cancellation is made 60-89 days prior to arrival.
C. 100 % of the total rental amount will be forfeited if the cancellation is made between 1 to 59 days prior to arrival.
D. No refunds or adjustments will be made from any portion of your vacation or attendant services not utilized
E. Extenuating Circumstances Policy: This Extenuating Circumstances Policy explains how cancellations are handled when unforeseen events beyond your control arise after booking and make it impracticable or illegal to complete your reservation. Guests who cancel will have options in the following conditions:
(i)Changes to government inter-island travel requirements. If the Government mandates that inter-island travel is banned and/or the hotel/villa industry should shut down due to Co-vid would we offer the option of a refund. If a reservation has already begun (the check-in has passed) this extenuating circumstance does not apply.
(ii)Postponement : Should you choose to postpone your booking the aforementioned cancellation policy is forsaken. Postponement may be possible and is solely based on the discretion of management.
Conditions of Postponement:
1. The same villa must be rented.
2. The rental period can be increased but not reduced. e.g., if one books for 3 nights, the new booking should be 3 nights or more.
3. No refund- the rental fee cannot be refunded.
4. Specials: If you booked a special and have decided to postpone your booking outside of the month the special is being offered, the special no longer applies. The rental period can be increased but not reduced.
F. Changes & Refunds: Refunds will not be granted for late arrivals (later than the check-in time), premature departures, non-attendance, or a reduction in number of guests.
G. Early Departure: Upon the commencement of the rental period, should a guest thereafter wish to shorten the contracted rental period, the guest is not entitled to a reimbursement of any portion of the rental fee.
6. ADDITION TO HOUSE RULES
A. Nuisance: You agree not to create or allow to be created any disturbance at the villa or premises which would be a nuisance to the owners or occupiers of surrounding villas. This includes:
– playing music at an excessive level and using loud or offensive language.
– excessively loud conversations especially after 10PM
– parking in such a manner as to interfere with other residents
– the use or consumption of illegal substances, which is strictly prohibited at the Villa.
B. Restrictions: Guests agree to be bound by the following restrictions:
1. Smoking is NOT allowed in any part of the Villa. A penalty applies for smoking indoors. Smoking outdoors is permitted.
2. Pets are not permitted.
3. The Villa is for use as vacation premises only and should not be used for large group events such as, but not limited to weddings, wedding receptions or parties unless approved in writing by Villa management. Contravention of any of these restrictions may result in the immediate termination of the rental agreement.
C. Plumbing Blockage: The owners or representatives of the Villa will not be responsible for any costs or losses as a consequence of blockages in the sewerage system due to foreign matter (e.g. sanitary pads or diapers) flushed down the toilets during your stay at the Villa. In addition, the guest will be liable for the costs associated with clearing the blockage and any subsequent sanitization of the premises.
D. Maintenance: The Villa shall bear the sole responsibility for maintenance and repairs. If any maintenance issue arises, the guests shall immediately notify the Villa, who will strive to effect repairs as soon as practicable. There shall be no refund or adjustment to the rental fee for unforeseen circumstances and/or circumstances beyond the control of the owners such as disruptions to the supply of electricity, water, television/cable, and internet services; and/or issues related to the pool filtration systems, air conditioning and appliances. It is the Guest’s obligation to report any problem or damage immediately to the property manager whilst on location. Failure to report any issues related to the maintenance and/or repair of the villa during the rental period shall result in a forfeiture of the right to make any claim arising therefrom.
E. Unauthorized removal of items from the villa: Guests agree not to remove any items from the villa such as furniture, appliances, bed and bath linen, furnishings, kitchen items, DVDs etc. Bath towels are to remain in the Villa and are not provided for use as beach towels. Guests shall be charged a fee equivalent to the cost of replacement of any item that has been removed.
F. Renters’ Rights: Guests who have paid the rental fee and are in compliance with their obligations under this agreement will be entitled to the enjoyment of the Villa and premises without undue interruption or interference from the owner or owner’s representatives, except when urgent remedial repair works might be required. Guests acquire no rights of ownership to the villa by virtue of this agreement or their occupation of the villa.
G. Guests shall dispose of trash in the following place and manner: All trash must be placed in garbage bags or placed in the garbage disposal upon departure. Guests agree to not dispose of any trash in the garden, the surrounding planters or around the pool deck. Sanitary napkins must also be properly disposed of and not flushed down the toilet.
H. Fire Hazardous Materials: Guests agree that Fireworks and other hazardous materials shall not be used in or around the property. Guests may only cook in the areas that are designated as such, such as a specific kitchen area. Guests are not permitted to create or maintain any open fires.
I. Illegal Use: Guests shall not use the Villa for any illegal purpose, including but not limited to illegal drug use, harboring a fugitive, prostitution, or abuse of any person or animal. If Guest is found to be engaging in any illegal activities on the Villa, this shall be cause for immediate termination of this Agreement.
J. Amendments: Any amendments or exceptions to any of the above mentioned clauses must be agreed to in writing prior to the commencement of the rental period.
K. Severability: If any part, term or provision of this Agreement is held to be illegal or unenforceable neither the validity nor enforceability of the remainder of this Agreement shall be affected.
L. For the rental of Olive Branch Villa this agreement is made between Mr. Daren Bayley-Hay (owner) and the Guest. The Guest shall refer all issues related to the Villa to Rhea Alert (Property Manager) arising from any portion of your vacation or attendant services not utilized.
7. INDEMNITY AND UNFORESEEN EVENTS
The Client agrees to indemnify and hold harmless the management of Olive Branch Villa, the owners of Olive Branch Villa, the staff of Olive Branch Villa from and against any and all claims, damages, losses and expenses, including reasonable attorney’s fees, arising out of the Client’s use of the Villa, except where such damage, loss or expense was due to the gross negligence of the owners of the Villa.
The Client also agrees not to hold the owners of Olive Branch Villa responsible for failure to provide the basic facilities and services due to emergencies or Acts of God. In the case of a mandatory evacuation due to an Act of God, Olive Branch Villa will allow the Client to reschedule if possible and/or receive a full refund of the deposit amount. Last minute cancelations due to inclement weather will not be considered for refunds.
8. ADHERENCE TO VILLA RULES
The Client understands that all persons in attendance at the Villa, including guests and visitors where applicable, shall abide by the Villa Rules in Schedule A below while on the property.
9. LIABILITY
It is agreed between the Parties that the Olive Branch Villa, it’s directors, management and staff and the owners of Olive Branch Villa shall not be held liable by the Client or the Client’s guests or visitors to lawsuit, actions, damages and expenses in connection with loss or injury to person, property or otherwise resulting directly or indirectly from the use of the Villa or Act of God, dangers incident to the sea, fire, breakdown of machinery, equipment, acts of the Government or other authorities, de jure or de facto, wars whether declared or not, hostilities, civil disturbances, strikes, riots, thefts, pilferage, epidemics, quarantines, customs regulations, delays or cancellation or changes in itinerary or schedule, or from acts or omissions of any kind or in any way related to the accommodation or transportation offered herein or due to any other cause beyond the control of Olive Branch Villa.
You agree to ensure the proper supervision of all guests (especially children and infants if any) while in occupancy of the Villa, and especially in or around the swimming pool. Overseas guests are encouraged to obtain travel insurance to cover disruptions to their holiday in the event of unexpected factors such as family or health emergencies or travel disruptions due to weather or other unforeseen causes.
